Welcome to FCM Wallet ("we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and FCM Wallet regarding your access to and use of our self-custodial cryptocurrency wallet application, website, and related services (collectively, the "Service").
BY ACCESSING OR USING OUR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.
1. Definitions
For the purposes of these Terms:
- "Wallet" means the non-custodial cryptocurrency wallet software provided by FCM Wallet.
- "Digital Assets" means cryptocurrencies, tokens, and other digital assets supported by the Wallet.
- "Private Keys" means the cryptographic keys that control access to Digital Assets.
- "Smart Contracts" means self-executing contracts with terms directly written into code.
- "DeFi Services" means decentralized finance services accessible through the Wallet.
2. Eligibility and Account Registration
2.1 Age Requirement
You must be at least 18 years old or the age of legal majority in your jurisdiction to use our Service. By using FCM Wallet, you represent and warrant that you meet this age requirement.
2.2 Compliance with Laws
You must comply with all applicable laws and regulations in your jurisdiction. You may not use FCM Wallet if you are located in, or a citizen or resident of, any jurisdiction where the use of cryptocurrency wallets is prohibited.
2.3 Account Security
You are solely responsible for:
- Maintaining the security of your wallet credentials, including seed phrases and Private Keys
- All activities that occur under your wallet
- Any loss resulting from unauthorized access to your wallet
- Backing up your wallet information
3. Nature of Service
3.1 Non-Custodial Wallet
FCM Wallet is a non-custodial wallet service. This means:
- You have sole control over your Private Keys and Digital Assets
- We cannot access, recover, or restore your Private Keys or seed phrases
- We do not hold, control, or have custody of your Digital Assets
- You are solely responsible for securing and backing up your wallet information
3.2 Software License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the FCM Wallet software for personal, non-commercial purposes.
4. Wallet Creation and Security
4.1 Creating Your Wallet
When creating a wallet, you will be provided with a seed phrase. You acknowledge that:
- Your seed phrase is the only way to recover your wallet
- Anyone with access to your seed phrase can access your Digital Assets
- Loss of your seed phrase will result in permanent loss of access to your Digital Assets
- We cannot recover lost seed phrases or Private Keys
4.2 Security Best Practices
You agree to:
- Never share your seed phrase or Private Keys with anyone
- Store your seed phrase securely offline
- Use strong device security (PIN, biometric authentication)
- Keep your wallet software updated
- Verify all transaction details before confirming
5. Prohibited Activities
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any applicable laws, regulations, or third-party rights
- Engage in money laundering, terrorist financing, or other financial crimes
- Use the Service to transmit malware or engage in phishing
- Attempt to gain unauthorized access to our systems or other users' wallets
- Reverse engineer, decompile, or disassemble the software
- Use the Service in any way that could damage our reputation or business
- Engage in market manipulation or fraudulent trading activities
6. Third-Party Services and Content
6.1 DeFi and DApp Integration
FCM Wallet may allow you to interact with third-party decentralized applications (DApps) and DeFi protocols. You acknowledge that:
- We do not control or endorse these third-party services
- Your use of DApps and DeFi services is at your own risk
- We are not responsible for any losses from third-party services
- You should review the terms and risks of each third-party service
6.2 Price Information
Any price information displayed in the Wallet is for informational purposes only and may not be accurate or up-to-date. You should not rely solely on this information for trading decisions.
7. Fees and Charges
7.1 Network Fees
You are responsible for paying all blockchain network fees (gas fees) associated with your transactions. These fees are paid to network validators, not to FCM Wallet.
7.2 Service Fees
We may charge fees for certain services, such as:
- Token swaps
- Cross-chain transactions
- Fiat on/off ramp services
- Premium features
All applicable fees will be clearly disclosed before you complete a transaction.
8. Risks and Disclaimers
8.1 Cryptocurrency Risks
You acknowledge and accept the following risks:
- Digital Assets are highly volatile and can lose value rapidly
- Transactions are irreversible once confirmed on the blockchain
- Smart contracts may contain bugs or vulnerabilities
- Regulatory changes may affect the value or legality of Digital Assets
- Technical issues or network congestion may delay transactions
8.2 No Investment Advice
Nothing in our Service constitutes investment, financial, legal, or tax advice. You should consult with qualified professionals before making any financial decisions.
8.3 Service Availability
We do not guarantee that the Service will be available at all times. The Service may be subject to:
- Scheduled or emergency maintenance
- Technical issues or bugs
- Network congestion or failures
- Regulatory restrictions in certain jurisdictions
9. Intellectual Property
9.1 Our Intellectual Property
All content, features, and functionality of FCM Wallet, including but not limited to software, text, graphics, logos, and trademarks, are owned by us and protected by intellectual property laws.
9.2 Open Source Components
FCM Wallet may include open source software components. Such components are subject to their respective open source licenses.
10. Privacy and Data Protection
Your use of our Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using FCM Wallet, you consent to our data practices as described in the Privacy Policy.
11. Indemnification
You agree to indemnify, defend, and hold harmless FCM Wallet, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
- WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
- WE ARE NOT LIABLE FOR ANY LOSS OF DIGITAL ASSETS DUE TO YOUR ACTIONS OR INACTIONS
13. Termination
13.1 Termination by You
You may stop using our Service at any time. Deleting the wallet app does not delete your wallet from the blockchain.
13.2 Termination by Us
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.
13.3 Effect of Termination
Upon termination:
- Your license to use the Service will immediately cease
- You remain responsible for all transactions initiated before termination
- You retain access to your Digital Assets through your Private Keys
14. Governing Law and Dispute Resolution
14.1 Governing Law
